Alternatives to Domestic Asset Protection Trusts

The Domestic Asset Protection Trust (DAPT) is a relatively new estate planning option for Michiganders. The DAPT allows a person to create an irrevocable trust, title assets in the trust, have those assets provide for their future needs, while also protecting those assets from the person’s future creditors. We recognize that the DAPT may not be right for everyone.
At the February 2018 meeting, Attorney John Mabley of Chalgian & Tripp Law Offices will share his experience of clients who need such protection but are not a good fit for DAPT and provide examples of alternatives. Ric Walton and Kyle O'Malley of the Walton Insurance Group will inform the group on what products are available for clients who have significant wealth and have significant risks of being sued, but likewise are still not a good fit for DAPTs.

John D. Mabley, is a graduate of the University of Michigan and Wayne State University Law School. He is a fellow of the American College of Trust and Estate Counsel and serves as chair for the Michigan chapter of that organization. He is also the former chair of the Probate and Estate Planning Section of the Michigan State Bar. John has been listed for more than 10 years under the estate planning and probate category of Best Lawyers in America and has also been named to the Michigan SuperLawyers list since 2007. John concentrates his practice in the areas of estate planning, probate and trust administration, and trust and estate litigation.
Kyle O'Malley, Executive Vice President of Walton Insurance Group, has an extensive background in the financial and investment area, as well as insurance. He has over 24 years of experience working with public & private high-growth organizations. His professional experience includes working with The Hylant Group in Ann Arbor as Vice President, Shane Group Corporation in Jackson as Vice President, and Deloitte & Touche in Kitchener, Ontario as a Senior Chartered Accountant. He is COO, Exec VP, and a Board Member of Worth Investment Group, Worth Holdings, LLC in Jackson. His education includes a BA-Economics from Wilfrid Laurier University in Waterloo, Ontario. Kyle holds the CIC (Certified Insurance Counselor) designation, and is licensed in Life, Accident, Health, Property & Casualty in Michigan
Eric "Ric" B. Walton, a native of Jackson County, Michigan, has over forty three years of insurance and finance experience. Ric was introduced to his father's business, the Walton Agency, as a youngster which instilled in him the value of protecting and serving the people. Pursuing a Bachelor's in Business Administration with a concentration in Finance, Ric graduated from Western Michigan University in 1973. Shortly after graduating, he began working as an insurance underwriter for US F&G, but later returned to his father’s business and began working with local Jackson County organizations and families.
